Article 2 – Applicability and conditions
These general terms and conditions relate to all services and communication and every offer (including via post, telephone, mobile phone, e-mail, website, …) that is provided to you by T Sekai Bonsai. By using these services or relying on these communications, you agree to these terms and conditions. To place an order or make a purchase, you must be at least 18 years old. If you are not 18, we ask that your parents or legal guardian place the order. If we notice that an order has been placed by a minor, we can refuse this order.
The T Sekai Bonsai website is a guide when searching for T Sekai Bonsai products. You also have the option to buy products via this website; to reserve, subscribe to communications by post and electronic communications and other information.
T Sekai Bonsai reserves the right, at any time and for any reason, to change and/or supplement the content of the terms and conditions without prior notice. If one of these terms and conditions should be invalid for whatever reason, the other terms and conditions will remain fully applicable.

T Sekai Bonsai always describes as fully and accurately as possible what is being sold and how the ordering process will take place. In any case, the description is sufficiently detailed to make a proper assessment of the item. Mistaking is always a possibility. If a mistake occurs , T Sekai Bonsai is not obliged to deliver the corresponding good.
Orders

The purchase is final as soon as we receive your payment. Payment transactions with credit or debit cards require us to receive approval from the card issuer. If your card issuer refuses to agree to your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.

To purchase a product, add the product to your shopping basket. Then enter your contact details and billing information. In the last step, you get a summary page, accept our general terms and conditions, which can be consulted on the website, and confirm your payment by pressing the order button labelled ‘complete order’. Once you have completed these steps and as soon as T Sekai Bonsai has received approval of the payment transaction from the bank issuer, your purchase is final. T Sekai Bonsai will reserve the items for you in the shop for a maximum of seven days.
Article 4 – Right of withdrawal (cooling-off period) in distance selling
The right of withdrawal granted to the consumer only applies if the contract was concluded remotely (website, telephone, etc.). Consequently, the right of withdrawal does not apply to reservations made via the website and to collection in the shopThe right of withdrawal means that you have the right to decide not to keep the goods and amounts to 14 days from delivery of the article. During the first 14 days after delivery, we expect you to treat the order and its packaging with care. If you still wish to return the goods as described above, you may only unpack or handle them to the extent necessary to establish the nature, characteristics of the goods. If you return the goods, this must be done with all delivered accessories and in the original state and original packaging.
If you wish to return the goods to T Sekai Bonsai, this can only be done by contacting T Sekai Bonsai.
The direct cost of returning the goods will be at your expense. If it is impossible to return the goods by post, we will collect them from you. We will indicate the cost price of this or make an estimate, if this cannot reasonably be calculated in advance.

Article 5 – Price
Our prices are in euros and include all taxes, VAT, recupel, duties and services. T Sekai Bonsai may charge shipping and service costs on top of the price. This will be clearly indicated before the order is finalised.

Article 7 – Home Delivery
Only items marked ‘Home delivery possible’ can be delivered to your home.
All goods that you have delivered to your home will be delivered to the address indicated by you when placing the order.
The transport cost is clearly indicated with the article even before the order is placed.

Home deliveries will only be made within the European Union, excluding the UK.
If T Sekai Bonsai is unable to deliver on time, T Sekai Bonsai will always inform you before the expiry of the scheduled delivery period.
Shipments are always made at the risk of T Sekai Bonsai. However, if you return goods to us, you are responsible for the transport.
If the goods delivered by us were damaged during transport, do not match the items listed on the delivery note or do not match the items you ordered, you must report this as soon as possible and certainly within 3 days. Please use the contact page to find an appropriate solution.You can only return the goods to T Sekai Bonsai shop.We cannot be held responsible for any consequential damage due to late delivery or non-delivery by the carrier appointed by the company. Our liability in such cases remains up to the value of the items shown not to have been received by the customer.

In case of force majeure, we are not obliged to fulfil our obligations. In that case, we may either suspend our obligations for the duration of the force majeure or dissolve the agreement definitively.
Force majeure is any circumstance beyond our control that prevents the fulfilment of all or part of our obligations. By this we mean, inter alia, strikes, fire, operational failures, energy failures; failures in a (telecommunication) network or connection or communication systems used and/or the unavailability of our website at any time.

The liability of T Sekai Bonsai is always limited to the direct, personal damage suffered and can never exceed the purchase price of a product.
